Terms of Use

These Terms of Use ("Terms") govern your use of the Onyx Wallet mobile application (the "App") provided by Onyx ("we", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. The App

Onyx is a non-custodial cryptocurrency wallet that allows you to generate, import, and use self-custody wallets on the HyperEVM network. The App is a software tool. It is not a bank, broker, exchange, custodian, money transmitter, or investment adviser.

2. Self-custody & your responsibility

  • Your recovery phrase and private keys are generated and stored on your device. Only you have access to them.
  • You are solely responsible for keeping a secure backup of your recovery phrase and private keys.
  • We cannot recover, reset, freeze, or reverse your wallet, your keys, or any transaction. Loss of your backup means permanent loss of access to your assets.
  • You are solely responsible for the accuracy of the addresses you send to, the amounts you send, and the network fees you pay.

3. No financial advice

The App may display market information such as prices, 24h change, market capitalization, volume, and charts. This information is provided "as is" for reference only, is sourced from third parties, and may be inaccurate, delayed, or unavailable. Nothing in the App constitutes investment, financial, legal, or tax advice, or a recommendation to buy, sell, or hold any asset.

4. Risks

  • Crypto assets are volatile and may lose all value.
  • Blockchain transactions are generally irreversible once broadcast and confirmed.
  • Network conditions may cause delays, failed transactions, or higher fees.
  • Smart contracts and tokens interact at your own risk. Some tokens may be scams or malicious.
  • Regulation of crypto assets varies by jurisdiction. You are responsible for compliance in your location.

5. Eligibility & compliance

You must be at least 18 years old to use the App. You represent that your use complies with all laws and regulations applicable to you, and that you are not located in, or a resident of, any jurisdiction where using the App would be unlawful.

6. Prohibited use

You agree not to use the App:

  • To violate any law or third-party right, including money-laundering, terrorism financing, or sanctions laws.
  • To reverse engineer, decompile, or attempt to extract source code except as permitted by law.
  • To interfere with the operation of the App or the underlying networks.

7. Third-party services

The App interacts with third-party services such as public HyperEVM RPC endpoints and market data providers. We do not control these services and are not responsible for their availability, accuracy, or content. Your use of third-party services is subject to their terms.

8. Intellectual property

The App, including its trademarks, logos, and content, is owned by Onyx or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control.

9. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONYX AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, LOSS OF DATA, OR LOSS OF DIGITAL ASSETS, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR AGGREGATE LIABILITY WILL NOT EXCEED FIFTY U.S. DOLLARS (US$50).

11. Indemnity

You agree to indemnify and hold harmless Onyx and its affiliates from any claim or demand arising from your use of the App, your violation of these Terms, or your violation of any law or third-party right.

12. Apple-specific terms (EULA)

  • These Terms are between you and Onyx only, and not with Apple. Apple is not responsible for the App or its content.
  • Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms.
  • Apple has no obligation to furnish maintenance and support services with respect to the App.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation.
  • Apple is not responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability, consumer protection, or intellectual property claims.
  • You represent that you are not located in a U.S.-embargoed country and are not on any U.S. government restricted-parties list.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes

We may update these Terms. Continued use of the App after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Onyx is established, without regard to conflict-of-laws principles. Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.
